What does the Caliph Umar Abdul Aziz wannabe have to say?

In view of the swirling hudud controversy between DAP and PAS, we thought the stories below worth drawing attention too.

On Aug 19, The Guardian reports that Saudi Arabia’s strict enforcement of sharia law sees ‘an eye for an eye’ punishment sought for by a complainant following a cleaver attack.

According to the paper, Abdul-Aziz al-Mutairi, 22, was left paralysed after a fight more than two years ago, and asked a judge to impose an equivalent punishment on his attacker under sharia law.

“Sharia law in Saudi Arabia allows defendants to ask for a similar punishment to harms inflicted on them.”

The above case refers to Saudi vs Saudi. But what happens if it’s a black-skinned maid vs a Saudi?

But before we go to the story of the Sri Lankan maid who was abused, here’s a flashback to the case of  Saudi vs black skinned foreign worker — ‘Court orders eye to be gouged out’:

The Greater Shari`a Court of Dammam sentenced Puthan Veettil `Abd ul-Latif Noushad, an Indian citizen, to be punished by having his right eye gouged out in retribution for his role in a brawl in April 2003 in which a Saudi citizen was injured. …The injured Saudi man has so far insisted that the sentence be carried out, refusing to pardon Noushad or accept monetary compensation. …

The witness, also a worker from India, told Human Rights Watch that the court refused to admit his testimony backing up Noushad’s account. The judge reportedly said that non-Saudis were barred from testifying in cases involving Saudis. Noushad’s Saudi employer confirmed that the judge did not fully take into account the circumstances of the brawl.

Returning to the present, this story below made headlines all over the world yesterday.

Sri Lankan maid L.G. Ariyawathi, who was hospitalized with severe pain after returning Saturday from Saudi Arabia, has said the family she worked for punished her by heating the nails and needles before sticking them into her. X-rays showed that she had 24 nails and needles in her body, said Dr Keerthi Satharasinghe of Kamburupitiya hospital, about 100 miles (160km) from the [Sri Lanka] capital, Colombo.

Since being hospitalized, Ariyawathi, 49, has described the abuse meted out by her employers. (CBSnews)

“They did not allow me even to rest. The woman at the house had heated the nails and then the man inserted them into my body,” Ariyawathi was quoted as saying by the Lakbima newspaper.

Indonesian and Filipino consulates maintain safe houses for their nationals who are domestic workers in the Saudi kingdom due to the rampant mistreatment.

Left is Indonesian Nour Miyati, 25, who contracted gangrene after allegedly being tied up for a month and left without food in 2005. She had to have several fingers and toes amputated. Story about the maid tortured by her Saudi employers in 2008,  here.

Karpal Singh and Nik Aziz — who do not see eye to eye on hudud — have stated their positions on the implementation of Islamic criminal law in Malaysia.

So what does Lim Guan Eng as DAP sec-gen have to say about this matter, all the more since his state Penang is modelled after Islamic governance?

    Dear Harris,
    does Islam condone such torture? Does the great Allah allow such
    treatment of one’s fellow being? This is why our dear RPK condemns

    It’s the same hypocrisy, like saying John Allen Muhammad got the needle but Steven Dale Green got life sentence (and his band of gang rapists acquitted), but does it mean we cannot use the US as model of democratic governance?

    Btw, the Saudi dynasty and the Umayyad caliphate of Damascus (where Umar bin Abdul Aziz was one of its rulers) are almost a millenium apart. Try to differentiate between them just like how we differentiate Christians who worship Allah and Christians who say ‘Allah is a moon-god’.

    Hartal MSM: You say that the Saudis are almost 1,000 years post-Umar, so may we ask you why the hudud punishments remain unchanged, like stoning, chopping off limbs and the rest. You can show us the differentiation, please?

      I would still say aye on laws that chop off limbs of convicted thieves over the laws that could not protect let’s say kindergarten teacher Leong Lai Yong, while the same laws may punish you if you manage to kill the thief just to defend yourself.

      Stoning and chopping of limbs have been around even during the age of The Ten Commandments and the Kingdom of Israel for offences like “‘If a man commits adultery with another man’s wife” or “‘If a man lies with a man as one lies with a woman”. Try reading the Old Testament (e.g. Leviticus 20) to get a greater historical view of hudud laws.

      Let’s not forget to look West but for their failures, such as failure of pledge of abstinence to prevent premarital sex and how the US has over 2 million of prison population, not to mention newly discovered STDs.

      To quote from a dialogue in V for Vendetta movie, “Do you think He is not watching us?”

    If the chopping of limbs were adopted here in M’sia, there would be lots of limbless criminals in the system, don’t you think ? Imagine the cruel nation of sentencing in a case in Iran whereby a criminal had one hand chopped off and an opposing leg hacked off for good measure(right hand left leg, rendering person an invalid).

    In the West, People For The Ethical Treatment of Animals(PETA) are most vocal defending their cause. I sometimes laugh my head off thinking these activist have too much time in hand, but then again, PETA is borne out of a progressive society where liberty/rights are not taken for granted and lucky them chickens. As an end result of PETA’s protest, chickens served up in KFC have that much more square inches compared to before (do ignore my attempt at jest ‘cos PETA have their place in heaven and have brought better living conditions for horses, cow, pigs, dogs, monkeys etc – even Muslims one’s).

    Also, my reservation questions the offer of “blood money” as settlement under Syariah, a concept that runs contrary to the secular nature of most jurisdictions. Very simply, isn’t this clear indication that those who have the means are liable or able to buy their way out of trouble ?

    Question : Is the offer of “blood money” derived from the good book or its origin from some edict ? Answer to question would be greatly appreciated. Thanks in advance.

    Thumbs up to Hudud law and hope it gets into Malaysia soon enough..I live in ME and there is nothing greater here than the low crime rate.
